What a Georgia Medical Practice Needs

Medical professional liability is the policy every physician thinks about. It is one of six your practice needs, and it does not cover most of what can go wrong in your office.

A complete program for a Georgia medical practice includes:

  1. Medical Professional Liability, also called malpractice, for claims arising from patient care.
  2. General Liability (GL) for injury and property damage inside your office.
  3. Commercial Property for your building, improvements, and equipment.
  4. Workers Compensation (WC) for employee injuries.
  5. Cyber Liability for patient record breaches.
  6. Employment Practices Liability (EPL) for claims brought by your staff.

Injury Claims

A limit chosen a decade ago against an assumed statutory ceiling no longer reflects the exposure accurately. Recent injury and malpractice claims against medical professionals in Georgia have grown, with a few of note listed below:

Claims-Made Coverage, Retroactive Dates, and Tail

Most medical professional liability is written on a claims-made form. That form works differently from the occurrence forms used for general liability, and the difference costs practices money at the worst moment.

A claims-made policy responds to claims reported while the policy is in force. The care can have occurred years earlier. What matters is when the claim arrives.

Your retroactive date defines how far back coverage reaches. Care provided before that date is not covered, regardless of when the claim is filed. When you change carriers, protect your retroactive date. A new policy with a new retroactive date leaves every prior year uncovered.

Tail coverage protects you after the policy ends. Also called an extended reporting period, it covers claims reported after you retire, change carriers, or leave a practice. Prior acts coverage from a new carrier can serve the same purpose.

A physician who retires without tail coverage remains exposed to claims for years after the last patient visit. Do not let a policy lapse or a carrier change happen without confirming what covers your prior work.

What Malpractice Coverage Does Not Reach

A patient who slips in your waiting room is not a malpractice claim. A staff member who alleges wrongful termination is not a malpractice claim. A ransomware attack on your practice management system is not a malpractice claim.

General liability covers premises injury. Waiting rooms, parking areas, and exam room falls unrelated to treatment.

Cyber liability covers a breach of protected health information. Notification costs, forensic investigation, regulatory response, and ransomware. Medical practices hold concentrated volumes of sensitive data, and a breach carries both cost and reporting obligations.

Employment practices liability covers claims by employees. Discrimination, harassment, and wrongful termination. Practices with front office and clinical staff carry this exposure whether or not they buy the coverage.

Commercial property covers your building, build-out, imaging equipment, and contents. Diagnostic equipment values are high and frequently under-scheduled.

Equipment breakdown covers mechanical and electrical failure of equipment your property policy does not.

We review all six lines on every practice we quote. Most practices arrive carrying two.

Georgia Workers Compensation for Medical Practices

Georgia law requires workers compensation coverage once a business employs three or more people. The count includes part-time employees.

Clinical staff carry needle-stick and bloodborne pathogen exposure. Front office staff carry ergonomic and slip exposure. Both sit on the same policy at different rates.
